Summary: These terms govern your use of GetInventy. By using the service you agree to them. If you are a healthcare provider handling patient data, a Business Associate Agreement is also required.
These Terms of Service ("Terms") constitute a binding agreement between you (the clinic, organisation, or individual using the service, "you" or "Client") and Mobingo ("we", "us"), the operator of GetInventy. By accessing or using GetInventy at any of its domains or subdomains, you agree to these Terms. If you do not agree, do not use the service.
GetInventy is a web-based medical and dental inventory management system. It enables clinics to track drugs, devices, implants, batches, stock levels, transfers, placements, and related records. The service is provided on a subscription basis and is intended for use by authorised clinical and administrative staff.
You agree not to:
If you are a Covered Entity under HIPAA and you intend to store Protected Health Information (PHI) — including patient names associated with implant placement records — you must execute a Business Associate Agreement (BAA) with Mobingo before entering any PHI. You accept sole responsibility for any PHI entered without a BAA in place.
You are responsible for ensuring that only appropriately authorised staff are granted access to PHI within the service. We provide role-based access controls to assist with this; configuration and enforcement is your responsibility.
All inventory, patient, and operational data you enter into the service belongs to you. We process it solely to provide and improve the service. Upon account closure, we will provide you with an export of your data in CSV format upon written request made within 30 days of closure. After 12 months from account closure, non-PHI data may be permanently deleted. PHI is retained for 6 years per HIPAA requirements and then deleted.
We aim for high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. We are not liable for losses resulting from service unavailability outside our reasonable control.
The GetInventy platform — including its code, design, branding, and documentation — is the intellectual property of Mobingo. These Terms do not grant you any rights to our intellectual property beyond the limited licence to use the service as described. The GetInventy name, logo, and wordmark are trademarks of Mobingo.
Subscription fees are agreed upon at onboarding and invoiced monthly or annually. We reserve the right to adjust pricing with 30 days written notice. Accounts with overdue balances may be suspended after a 14-day grace period.
To the maximum extent permitted by applicable law, Mobingo's total liability to you for any claim arising from or related to these Terms or the service shall not exceed the total fees paid by you in the 12 months preceding the claim. In no event shall we be liable for indirect, incidental, consequential, or punitive damages.
The service is provided for inventory tracking purposes. Clinical decisions — including drug dispensing, implant selection, and patient care — remain the sole responsibility of qualified healthcare professionals. The service is not a substitute for professional clinical judgement.
You agree to indemnify and hold harmless Mobingo and its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your violation of any applicable law or third-party right.
Either party may terminate the agreement with 30 days written notice. We may terminate immediately if you materially breach these Terms and fail to remedy the breach within 7 days of written notice. Upon termination, your access to the service will cease and data export procedures in section 6 apply.
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions. Any dispute shall be subject to the exclusive jurisdiction of the courts of Virginia.
We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
